    FAQ

    Under section 21 of the Criminal Procedure Code, the investigation officer can compel your attendance and you must attend. If you fail to attend, a warrant can be issued against you.

    Under section 22(2) of the Criminal Procedure Code, you need not say anything that may expose you to a criminal charge. That does not mean you can lie to the investigation officer. Under the law, you are to state the truth and if you feel that anything you say may incriminate you, it is better not to say anything at all. Remember, it’s the police/prosecution that has to prove its case against you.

    We strongly suggest you consult a lawyer as soon as you are called up by the police or other enforcement agencies like MOM, ICA, LTA etc. If you are not able to consult a lawyer before seeing the investigation officer, we suggest you do it straight after. It does make a difference as the lawyers will be able to intervene by making pre-charge representations on your behalf to mitigate or rebut depending on the evidence. Favourable outcomes such as being administered a stern or conditional warning, reduction of charges, or even getting a no further action (NFA) are possible.
